These Terms of Service (“Terms”) govern your use of our website located at www.clicksy-marketing.com (the “Site”) and the services provided by Clicksy (“we”, “us”, or “our”), including but not limited to advertising strategy, Facebook Ads management, and performance reporting (the “Services”).
By accessing or using our Site and Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.
You must be at least 18 years old and legally capable of entering into a binding contract to use our Services. By using our Site, you represent and warrant that you meet these requirements.
Clicksy provides advertising services, including the planning, setup, and management of Facebook Ads campaigns. The scope of work and deliverables will be defined in a separate agreement or invoice per client engagement.
We do not guarantee specific results (e.g., number of leads or sales), and all performance is subject to variables including platform algorithms, audience behavior, and market conditions.
As a client, you agree to:
● Provide accurate and complete information required for ad campaign setup.
● Grant us access to your Facebook Business Manager and Ad Account, if applicable.
● Respond to our requests for feedback or approvals in a timely manner.
● Ensure your business complies with Facebook’s advertising policies.
Failure to fulfill these responsibilities may delay or impact campaign performance, for which Clicksy is not liable.
Fees are agreed upon in advance and are due as specified in the invoice or proposal. We reserve the right to suspend or terminate service if payment is not received on time.
All payments are non-refundable unless otherwise stated in writing.
Prices are listed in USD unless otherwise indicated. Payments are processed via Stripe or other secure platforms.
All original ad creatives, strategies, and copy provided by Clicksy remain the intellectual property of Clicksy until full payment is received. Upon full payment, rights to custom materials developed specifically for the client are transferred to the client unless otherwise agreed.
Facebook Ads accounts, brand assets, and data provided by the client remain the property of the client.
We respect your confidential information and agree not to disclose or use it for any purpose outside the scope of our business relationship. Likewise, you agree to maintain confidentiality regarding our strategies, pricing, and internal processes.
Either party may terminate the service agreement at any time with written notice. In such cases:
● Work already completed will be invoiced and must be paid in full.
● Ongoing campaigns will be paused or handed over as agreed.
We reserve the right to terminate services immediately if the client violates these Terms or engages in fraudulent, illegal, or abusive behavior.
Our Services are provided “as is” and “as available.” We do not guarantee that your campaigns will always be successful or that the Site will be error-free or uninterrupted. You use our Services at your own risk.
To the fullest extent permitted by law, Clicksy shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, revenue, or data, arising out of your use of our Services or Site.
Our total liability under these Terms shall not exceed the total fees paid by you for Services over the preceding 3 months.
These Terms are governed by and construed in accordance with the laws of the province of Quebec, Canada, without regard to its conflict of law provisions.
We may update these Terms from time to time. Any changes will be posted on this page with a new effective date. Your continued use of the Site and Services after any change constitutes acceptance of the updated Terms.
